GENERAL INFORMATION

Throughout this website, the terms "we", "us" and "our" refer to Paul Weaver and anyone working on his behalf to administer Paul Weaver Art. It is a condition that all visitors/users (referred to as "you") who access or use any part of this website, accept all terms, conditions and other policies stated and agree to be bound by them.

All intellectual property rights remain with Paul Weaver, the creator of all paintings and content displayed on this website. Copying, reproduction or distribution of any paintings or content of this website is not permitted. Please see additional copyright notice below.

These Terms and Conditions are governed by English law.

EVENT BOOKINGS

Terms and Conditions for any holiday or workshop organised and promoted by Paul Weaver will be emailed or posted on receipt of an enquiry about the respective event. Other providers, who employ Paul Weaver to tutor on their holidays, courses, workshops, or provide demonstrations, critiques or judge exhibitions, will have their own respective terms and conditions which will apply to these bookings and it is your responsibility to contact the relevant provider for these details.

All intellectual property rights remain with Paul Weaver, the creator of all paintings displayed on this website. Reproduction of any paintings or content of this website is not permitted, unless permission is agreed in advance and confirmed in writing by Paul Weaver. Please see additional copyright notice below.

We will not be held liable for any errors in the content of this website. The content of this website is intended for general information only and more accurate information can be accessed through contacting us directly either through the 'Contact' facility of this website, emailing us, telephoning us or directly contacting the various providers that Paul Weaver works for through their respective contact details (e.g., email addresses, telephone numbers and website links) displayed on this website.

We reserve the right to amend these terms and conditions and/or website content at any time. It is your responsibility to monitor and check for any amendments to the terms and conditions and/or website content. TERMS OF SALE

Please read through the following information to help you with your purchase. For any enquiries regarding sales, please email me through the ‘Contact’ area of this website.

This information relates to the purchase of goods directly from me, either through this website, in person or by other means and is not applicable to other retailers Paul Weaver works with, who may sell my work or products associated with me. For purchases made directly from them, please refer to their respective terms and conditions.

When you purchase a product, once your order and full payment are received, “you” (the buyer) enter into a contract/agreement with “we/us” (the seller).

To purchase anything on this website, you will need to sign up for an account.

Original paintings: the description, approximate size (including whether framed or unframed) and price of each painting is stated on this website.

Freestyle brush, greetings cards and videos: descriptions are stated on the website.

The price you pay for goods is the price displayed on our website when your order is received by us. The price of paintings or other goods may be changed by us at any time without notice. The stated price will not be changed once you have placed and paid for an order. All prices are include VAT.

Original paintings are subject to availability. Once we receive a payment for goods, if for any reason your order is unable to be fulfilled, we will notify you as soon as possible and offer either an alternative equivalent item or full refund.

In order to make true representations, the images of original paintings and other products on this website are displayed as carefully/accurately as possible. We cannot guarantee exact definition and colour matching to the original, due to the display settings of your equipment being beyond our control.

The price is shown in Pounds Sterling and the full price is payable at the point-of-sale. If goods are to be shipped outside of the UK, please note that your purchase may incur import duty for which you will be responsible. Please check the guidelines of the country the goods are to be shipped to. We recommend that the buyer checks this prior to purchasing.

Purchases of paintings and brushes can be made through PayPal using an existing account or checking out as a guest user, or by debit or credit card using Wix payments. Online payments are not processed or controlled by us. No payment details are recorded or stored by us. Online payment service providers should securely process your transaction. We recommend their terms and conditions are checked by you prior to making a transaction. We accept no responsibility for problems you may experience when making a transaction with our online payment service provider.

Goods will not be dispatched until full payment is received.

Once your payment has been received by us, you will receive an email confirming your order and receipt of payment. The goods ordered remain our property until we have received your cleared payment.

By ordering and paying for goods you agree and are bound by these terms of sale.

SHIPPING

ORIGINAL PAINTINGS

UK destinations: shipping is free to UK addresses. Paintings will be sent wherever possible with Royal Mail, using a trackable service.

Non UK destinations: a flat rate charge of £50.00 will be added to paintings to be shipped to any address outside of the UK.

FREESTYLE BRUSHES

UK destinations: a £2.00 postage and packing (P&P) charge will be added to the price of your order. Brushes will be sent wherever possible with Royal Mail.

Non UK destinations: a £9.00 postage and packing (P&P) charge will be added to the price of your order.

GREETINGS CARDS (SET OF 5)

UK destinations: shipping is free to UK addresses. Cards will be sent wherever possible with Royal Mail.

Non UK destinations: a flat rate charge of £5.00 will be added to each order of a set of greetings cards to be shipped to any address outside of the UK.

We aim to ship your order within 7-10 days and will contact you once it has been despatched. The only exception to this will be if we are away at the time of ordering, in which case your goods will be despatched as soon as possible and you will be notified accordingly. For shipping of original paintings, we will send your goods using an insured, trackable service and they will be delivered to the address provided by you when ordering. For shipping of Freestyle brushes, we will send your goods using a trackable mail service wherever possible. Please ensure address details are entered correctly when purchasing online, as we will not be held responsible for any errors made by you. We will deliver the goods you ordered to the address you provided at the point of purchase. Whenever possible, we aim to use a courier that requires a signature upon delivery. If the item cannot be delivered (as no-one is available to take delivery of it/sign for it) your goods will be taken to a delivery/sorting office and you will need to rearrange delivery or collect it yourself.

We cannot be held liable for the damage, delay or loss of goods caused by events that are beyond our control, such as ‘Force Majeure’.

VIDEO RENTAL/PURCHASE

Paul Weaver and Lune Limited own all intellectual property rights for videos on this website. Videos can either be rented for a stated period (immediately following the respective transaction) or purchased for unlimited streaming. Videos are not available to download.

Any unauthorised downloading, copying, editing, hiring, lending, public performance and/or broadcast of video content purchased or obtained from this website is strictly prohibited.

Rent: If you pay to stream a video from this website for a limited period, the video will be available once your transaction is complete for the specified rental period.

Purchase: If you pay to purchase a video from this website, for a one time payment the video will be available with unlimited streaming once your transaction is complete.

CANCELLATION

You have the right to cancel your order within 14 days from the day you receive your goods (this does not apply to video purchases). You must email Paul Weaver through the ‘Contact’ area of his website. Once you have informed Paul Weaver of your wish to cancel, you have a further 14 days to return the goods.

If your order is cancelled before we have posted it, a refund will be issued with the deduction of any fee that Paypal or Wix payments charged us with your transaction. If your order has already been posted, you will be fully responsible for the cost of returning the goods and in ensuring they are securely packed. We recommend you use a postal service that insures the goods in transit for the full value that you paid for them and is fully trackable, as you will be responsible for any claim arising from their loss or damage. It is your responsibility to carefully look after the goods whilst in your possession. In order to obtain a refund of the original purchase price, less any fees that Paypal or Wix payments charged us with your transaction, your returned goods must arrive undamaged in fully saleable condition. Additionally, brushes must be returned in unopened packaging and unused.

LIABILITY

Any liability by us or you in connection with any claim shall not exceed the purchase price paid for the items involved in the claim. We cannot accept liability for any losses created by unauthorised access to your information. This includes unauthorised access from our website or that of our payment service provider.

FORCE MAJEURE

We cannot accept responsibility for events and situations which are outside of our control that could affect shipping or result in damage to your goods.

Once a painting has been purchased, copyright of the image remains with Paul Weaver. By purchasing an original Paul Weaver painting, copyright of your purchase is not transferred to you and remains with Paul Weaver. You do not have any rights to reproduce, copy or distribute the image.
